Terms of Service

These Terms of Service ("Terms") govern your use of CAPScribe ("we", "our", or "us"), an AI-powered lesson planning platform for South African educators. By accessing or using the CAPScribe website, mobile application, or services (collectively, the "Service"), you agree to be bound by these Terms.

If you do not agree, you may not use the Service.

By creating an account, accessing, or using CAPScribe, you confirm that:

• You have read and understood these Terms
• You have the legal capacity to enter into this agreement
• You agree to comply with all applicable South African laws

CAPScribe is a digital platform that uses artificial intelligence to assist educators with:

• CAPS-aligned lesson plan generation
• Curriculum document analysis (CAPS, ATP files)
• Digital lesson exports (PDF and Word formats)
• AI-assisted planning tools and reminders

To use CAPScribe, you must:

• Be 18 years or older, or have legal parental/guardian consent
• Provide true, accurate, and complete account information
• Maintain the confidentiality of your login credentials
• Notify CAPScribe immediately of unauthorized access
• Not share, rent, or transfer your account to others

You are solely responsible for all activity under your account.

CAPScribe offers the following plans:

• Digital subscriptions are non-refundable once a billing cycle begins
• If a technical failure prevents access to paid features, CAPScribe will assess refunds on a case-by-case basis
• Chargeback abuse may result in account suspension

You agree not to:

• Use CAPScribe for unlawful, fraudulent, or harmful purposes
• Upload malware, viruses, or malicious files
• Attempt to breach, reverse-engineer, or exploit the platform
• Circumvent usage limits or security restrictions
• Use automation, scraping, or bots to overload the system
• Resell, sublicense, or commercially redistribute CAPScribe outputs without written permission

Violation may result in immediate account termination.

• All lesson plans are AI-generated recommendations, not guaranteed academic outputs
• Educators remain fully responsible for: Lesson accuracy, Curriculum alignment, Student outcomes
• CAPScribe is not liable for teaching results, student performance, or examination success

You retain ownership of:

• All documents you upload
• Your lesson prompts and personal content

CAPScribe retains ownership of:

• The software
• The AI system
• Platform infrastructure
• All branding and intellectual property

You receive a limited, non-exclusive license to use CAPScribe while your account remains active.

• CAPScribe complies with the Protection of Personal Information Act (POPIA)
• All personal data is handled according to our Privacy Policy
• Secure encryption is used for stored and transmitted data
• Financial data is processed via Stripe under PCI-DSS Level 1 compliance

CAPScribe aims for high availability but does not guarantee uninterrupted service. We may:

• Perform maintenance
• Deploy updates
• Patch security vulnerabilities
• Temporarily disable features when required

We are not liable for downtime caused by:

• Internet failures
• Cloud service outages
• Third-party system failures
• Force majeure events

CAPScribe reserves the right to suspend or terminate your account without notice if:

• You breach these Terms
• Engage in fraud or platform abuse
• Violate usage limits or security controls

Upon termination:

• Your access is revoked
• Your stored data may be deleted after a reasonable period
• Outstanding balances remain payable

To the maximum extent permitted by South African law, CAPScribe shall not be liable for:

• Indirect or consequential damages
• Loss of profits
• Loss of data
• Business interruption
• Academic or professional outcomes

Our total liability, if any, is limited to the amount paid in your last billing cycle.

You agree to indemnify and hold CAPScribe harmless from all claims, damages, losses, and liabilities arising from:

• Your misuse of the Service
• Violation of these Terms
• Infringement of third-party rights

We may update these Terms at any time. When we do:

• The "Last Updated" date will change
• Material changes will be communicated via email or in-app notification

Continued use of CAPScribe constitutes acceptance.

These Terms are governed by the laws of the Republic of South Africa. All disputes shall be subject to the exclusive jurisdiction of South African courts.
